Community Property

Community Property Attorney in Baton Rouge, Louisiana

One highly contested aspect of a divorce is how the property accumulated by the couple is to be divided. Since Louisiana is a community property state, it is important to have an attorney on your side who can explain the different aspects of community property division.

Under the guidance of experienced lawyer Mark Lazarre, we at Lazarre Law Firm provide comprehensive divorce and community property division representation to clients in Baton Rouge and across the state. Our goal is to help you understand your rights and pursue the property to which you are entitled. We take the time to explain community property, marital assets and marital rights to property so you know what you may or may not be able to retain or obtain.

What is community property?

Everything acquired during the marriage is considered community property. The courts consider the length of the marriage to be from date of the marriage to the date that the divorce petition is filed. Anything purchased, gifted or obtained during that period is community property, to which each party is entitled half of the value.

Debt Division

Marital debt is also subject to division. Any debt acquired during the marriage is split 50-50. This leaves both sides are responsible for all debt, instead of placing the burden on just one party.

Of course, there are exceptions in every community property division and divorce situation. Our firm can meet with you, listen to you explain your situation and determine the best way in which to proceed based on your goals and our assessment of the case.
