  • If you have no children, you must live apart for 6 months before the divorce petition can be filed and granted.
  • However, if you do have minor children, you must live apart for at least one year before the petition can be granted.

Clients often want to know how they can prove that they have been living apart for the specified time. The answer is simple: All you have to do is make a statement in front of a notary, who can then validate your response.

There are two ways to petition for divorce.

  • 103 Divorce - You have to be apart for the required time before the petition can be filed. Once this condition is met, the petition is typically granted without other requirements.
  • 102 Divorce - This type of divorce petition can be filed right away, but it requires a second pleading. Also, the process may be extended if there are children involved.
